Terms of Service & Carriage Conditions

1. Preamble & Scope of Application

These General Terms and Conditions govern all freight quotation requests, transit calculations, transport bookings, and carriage services initiated through TurkeyFreightQuote.com and executed by Brosan Uluslararası Taşımacılık ve Dış Ticaret Ltd. Şti. (hereinafter referred to as the 'Carrier' or 'Forwarder').

2. Quotations, Pricing & Indicative Benchmarks

Online freight quotes and benchmark calculations presented on this platform are indicative commercial estimates reflecting market rate brackets, fuel surcharges (BAF/CAF), currency valuations, and seasonal border transit charges at the date of inquiry. Binding transport contracts require written booking confirmation and equipment dispatch allocation from our central operations desk.

3. International Carrier Liability Framework

All international cross-border cargo movements coordinated by Brosan Lojistik are strictly subject to mandatory international transport conventions and statutory liability regimes:

• Road Freight: United Nations Convention on the Contract for the International Carriage of Goods by Road (CMR Convention, Geneva 1956) with carrier liability strictly limited to 8.33 SDR per kilogram gross weight.
• Maritime Shipping: Hague-Visby Rules / Hamburg Rules as stipulated in the ocean bill of lading (B/L) issued by contracted ocean carriers.
• Air Cargo: Montreal Convention 1999 (22 SDR per kilogram) governed by the air waybill (AWB) conditions of carriage.
• Customs & Bonded Transit: Turkish Customs Law No. 4458, NCTS Phase 5 electronic transit declarations, and A.TR/EUR.1 origin regulatory provisions.

4. Shipper Responsibilities & Cargo Documentation

The shipper or commercial consignor is solely responsible for ensuring export readiness, packaging suitability for international multimodal transport, accurate gross weight declarations under SOLAS VGM rules, and supplying complete customs documentation (Commercial Invoice, Packing List, Certificate of Origin, A.TR / EUR.1 documents).

5. Payment Terms, Demurrage & Claims Jurisdiction

Invoices are payable in accordance with the agreed credit terms established in individual service level agreements. Unloading delays exceeding agreed free times at European or Turkish terminals are subject to standardized daily demurrage/detention tariffs. All legal disputes arising under these terms are subject to the exclusive jurisdiction of the Istanbul Central Commercial Courts and governed by the laws of the Republic of Turkey.
